Tampa Concrete & Construction operates as a marketing and referral platform that helps connect homeowners, businesses, property managers, and other prospective customers with independent concrete contractors and service providers serving Tampa, Florida, and surrounding communities.
Unless expressly stated otherwise in a separate written agreement, Tampa Concrete & Construction does not directly perform, manage, supervise, inspect, warrant, or control construction work. Contractors and service providers are independent third parties and are not our employees, agents, partners, joint venturers, or representatives.
4. No Construction Contract Is Created
Visiting this website, submitting a form, requesting an estimate, speaking with a representative, receiving a referral, or communicating with a contractor does not create a construction contract with Tampa Concrete & Construction.
Any agreement concerning labor, materials, pricing, payment, scheduling, warranties, permits, inspections, change orders, project scope, or construction services exists solely between you and the independent contractor or service provider performing or offering the work.
5. Independent Verification of Contractors
You are responsible for independently evaluating and verifying any contractor or service provider before entering into an agreement. Verification may include reviewing licensing, insurance, qualifications, references, permits, complaint history, warranties, written estimates, and contract terms.
A referral, introduction, website listing, or response to an inquiry is not an endorsement, certification, guarantee, or representation that a contractor is suitable for your particular project.
6. Estimates, Pricing, and Project Information
Website content, pricing examples, project ranges, timelines, service descriptions, and estimate information are provided for general informational purposes only. They are not binding offers, guaranteed prices, or promises of availability.
Final pricing and project terms are determined by the contractor after reviewing the property, access, measurements, preparation requirements, materials, site conditions, permitting needs, drainage, scheduling, and other relevant factors.
You are responsible for reviewing all written estimates, contracts, warranties, payment schedules, and change-order provisions before authorizing work.
7. Appointment and Service Requests
Submission of an estimate or appointment request does not guarantee contractor availability, acceptance of a project, a specific appointment time, or completion by a requested date. Appointments may be changed or canceled because of weather, scheduling, staffing, access, emergencies, material availability, or other factors.
You agree to provide accurate project and contact information and to notify the responding contractor of access restrictions, hazards, property rules, pets, utility concerns, or other conditions that may affect a visit or project.
8. Telephone, Email, and Text Communications
By providing your telephone number or email address and submitting an inquiry, you authorize Tampa Concrete & Construction and contractors or service providers responding to your request to contact you about the requested project by telephone, email, or text message.
Message and data rates may apply. Consent to receive promotional communications is not a condition of purchasing services. You may request that promotional text messages stop by replying STOP, where supported, and may opt out of promotional emails through the unsubscribe method provided in the message.
We may continue to send communications reasonably necessary to respond to an active inquiry, provide requested information, document a transaction, or satisfy a legal obligation. Calls may be tracked, recorded, or transcribed when permitted by law and when any legally required notice or consent is provided.
9. User-Submitted Content and Project Photos
You may choose to submit project descriptions, photographs, measurements, files, reviews, messages, or other materials (“User Content”). You represent that you have the right to submit the User Content and that it does not violate another person’s privacy, intellectual-property, contractual, or other legal rights.
You grant us a nonexclusive, royalty-free license to use, reproduce, store, transmit, and share User Content as reasonably necessary to respond to your inquiry, facilitate a referral, operate the website, maintain records, and provide related services. We will not publicly use identifiable project photos for advertising without permission where consent is required.

16. Limitation of Liability

To the extent liability cannot lawfully be excluded, our total liability arising from or related to the website or referral services will not exceed the greater of the amount you paid directly to us for the specific website service giving rise to the claim or one hundred dollars ($100). This limitation does not apply where prohibited by law.
17. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Tampa Concrete & Construction and its owners, officers, employees, affiliates, representatives, vendors, and agents from claims, damages, liabilities, losses, judgments, costs, and reasonable attorneys’ fees arising from or related to:

19. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. To the extent permitted by law, any legal action arising from these Terms or your use of the website must be brought in a court of competent jurisdiction located in Hillsborough County, Florida, unless the parties agree otherwise in writing or applicable law requires a different forum.
20. Informal Dispute Resolution
Before filing a legal claim against Tampa Concrete & Construction, you agree to contact us and provide a written description of the dispute and the requested resolution. The parties will attempt in good faith to resolve the matter informally for at least 30 days after notice is received.
This section does not prevent either party from seeking urgent injunctive relief or taking action necessary to preserve a legal right or comply with an applicable limitations period.

If any provision of these Terms is found unenforceable, that provision will be modified or limited to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision or any other right.
22. Assignment

23. Entire Agreement
These Terms, together with the Privacy Policy, Disclaimer, and any other policies expressly incorporated by reference, constitute the entire agreement between you and Tampa Concrete & Construction concerning use of the website and supersede prior or contemporaneous communications on that subject.
A separate written agreement between you and an independent contractor is not part of these Terms and does not create obligations for Tampa Concrete & Construction.
